KANNUR DISTRICT CONFERENCE HELD SUCCESSFULLY.

Kannur District, one of the biggest District Branches in the country, has held its 5th biennial conference at Thalassery on 30-04-2018.  Com.P.V.Unnikrishnan, District President was in the chair. Com. M.P.Suresh Babu, Chairman, Reception Committee, welcomed one and all. Com.V.A.N.Namboodiri, Advisor in his inaugural address explained the organisational position, serious issues confronting the pensioners, especially pension revision , attempts to curtail the medical facilities. He stressed the importance of struggles through which important demands were achieved and appealed to strengthen the organisation further to continue the struggle. Coms. N.Guruprasad, Circle Secretary, K.Mohanan, former Circle Secretary, BSNLEU, V.P.Somasekharan, District Secretary, CGPA, Puthiyadavan Narayanan, District Secretary, AIPRPA, Raveendran Kodakkad, District Secretary, BSNLEU, V.V.Krishnan, District Secretary, BSNLCCLU, Deepak Kumar, District Secretary, SNEA, A.Balan, District Secretary, AIBSNLEA, Shri.Ashok Kallar, GMT,BSNL and Shri. The biennial report and audited accounts presented by Coms.K.Kunhiraman, District Secretary and K.Ramachandran, Treasurer were adopted after detailed discussion.

COM.SISIR BHATTACHARJEE PASSED AWAY.

Com.Sisir Bhattacharjee, the veteran leader of the P&T Trade Union movement in the country has passed away at 1825hrs on 30-04-2018 at Kolkata. He was the oldest leader (98) and will be remembered for his commendable contributions not only to the P&T workers but also other central government employees. He led many struggles along with Com.K.G.Bose and was an undisputed leader for several decades. Com.Sisirda was very active even at his old age until he fell seriously ill. 

AIBDPA expresses profound grief on the passing away of Com.Sisirda and conveys heartfelt condolences to the bereaved family and comrades. AIBDPA dips its banner in respect of Com.Sisirda and pays respectful homage.

Organise “Call Attention Day” on 03.05.2018 – Wear Black Badges and conduct Lunch Hour demonstrations.

The Agartala CEC meeting of BSNLEU has decided to observe a “Call Attention Day” on 03.05.2018. Lunch Hour demonstrations are to be organised on that day, by wearing Black Badges. The demands for the “Call Attention Day” are as follows. All circle and district unions are requested to make the maximum mobilisation for this programme.

  1. Stop the mad rush for outsourcing works.
  2. Curtail wasteful expenditures of the Company.
  3. Do not curtail the medical facilities of the serving and retired employees.
  4. Do not retrench the contract workers.
  5. Conduct fresh recruitment in the cadre of Sr.TOA.

The World Federation of Trade Unions (WFTU) in the name of its more than 92 million affiliates all over the world salutes, on the occasion of this great day, all the workers who live, work and struggle in every corner of the world. May Day was, is and will be a beacon for the struggles of yesterday and tomorrow despite our enemies’ efforts. May Day has to be a message of resistance against bourgeoisie, imperialists and their international alliances’ policies.

At the same time, the workers’ blood which was shed in Chicago on 1886 reminds us of our duty today; it reminds us that nothing is given for free; every right or freedom that was conquered by our class has been won through sacrifices, conflicts and organized struggles.

Today, whilst technology and scientific progress have contributed to the increase of the produced social wealth, our class’ living conditions have been deteriorating. In every capitalist country, the bosses attack our class achievements: they are sweeping through salaries, pensions and social security; they are privatizing everything, they don’t hesitate to attack even the sacred right to strike! Strike is the most powerful weapon we have in our hands and we are not going to allow anyone to limit, confine or convert it to a dead letter!

At the same time, they are intensively preparing and conducting regional wars.They pave the way for new massacres that will maximize their profits, for new imperialist interventions that will destroy nations, spill peoples’ blood and deprive them of their natural resources. The ongoing imperialist intervention in Libya and Syria, the growing aggression against Venezuela, the US decision to recognize Jerusalem as the capital of Israel, the massacre of Saudi Arabia against Yemen, the tension on the Korean peninsula, they are all indications that multinationals have smelled new profitability areas; and every time this goes through the dead bodies of workers.

Under the current conditions of the deep economic crisis of capitalism and intense competition among various imperialist centers to control new markets, our most powerful weapons are INTERNATIONALISM and SOLIDARITY. No worker must feel alone. All together, we must move on with Solidarity and Internationalism, building the Unity of the working class to give practical effect to Karl Marx’s motto “proletarians of all countries unite”.

In this context, and on this anniversary, the WFTU expresses its solidarity with our persecuted brothers, the immigrants and refugees, who either because of imperialists’ bullets or because of poverty and misery generated by this system, are forced to leave their homeland. The WFTU will continue to be on their side, fighting for a world without exploitation and refugees. Immigrants must become an integral part of unions, unite with local workers and fight together for wages, rights, against wars and interventions.

We join our voice with the heroic Palestinian people in order to gain their own independent and democratic homeland.

At the same time, we stand by the side of the struggling female worker, the one who suffers from double exploitation. The WFTU female members, at the recent World Women’s Congress in Panama, declared loud and clear that they want equal rights to work, society and life. The WFTU also fights and will continue to fight for this equality. It’s the same orientation that we follow for the the youngsters, as the new generation of workers have the task to honor the best May Day struggle traditions.

This year, the WFTU, by giving its hand to anyone who has stood up, has announced the year of trade union education and training. Our purpose is that the new shifts of workers be insubordinate, militant, enemies of class compromise and collaboration. We honor the year of trade union training and we call on every union to contribute to the militant truth, revealing the true meaning of May Day and the sacrifices the working class made for it. By rescuing the past, the very memory of our movement, we leave a legacy for tomorrow’s struggles and we also have a tool for the future. It is a duty to know the history of our movement.

The WFTU takes steps forward, strengthens and grows: and that’s what frightens our opponents. There is no other way than to make it present everywhere, in every corner of the world, so that there is no longer a hungry, dismissed, hunted or persecuted worker. The WFTU must be a “trench” of struggle for a future without exploitation of man by man. This is how the vision of the first Secretary General of the WFTU, Luis Saillant, envisioned in 1945 will be brought to life: “The WFTU for the workers of the whole world!”

The first biennial District Conference of Palanpur held on 18-04-2018 at Paschal Boarding, Palanpur was inaugurated by Com.M.B.Chaniyara, Circle Secretary and CHQ Organising Secretary. Com.Devubhai Joshi controlled the proceedings. Com.J.S.Tanna was the chief guest and addressed the conference. Those who greeted the conference included Coms.M.S.Korat and A.Y.Ghori, District President and Secretary of BSNLEU, G.B.Darji and N.N.Patel, AIBDPA Mehsana District President and Secretary.

The biennial report and accounts presented by Coms.J.K.Rami and V,M,Darji, District Secretary and Treasurer, respectively, were adopted after discussion. Then election of office beraers was held unanimously and the following are the main functionaries;

11. COMMUTATION OF PENSION

(11.1) How much of the pension can be commuted?

A pensioner can opt to commute up to 40% of the pension admissible at the time of retirement.

(11.2) Is there any restriction on commutation of pension?

 A pensioner can opt to commute up to 40% of the pension admissible at the time of retirement.

Yes. No Government servant against whom departmental or judicial proceedings as referred to in Rule 9 of the Pension Rules, have been instituted before the date of his retirement or the pensioner against whom such proceedings are instituted after the date of retirement, shall be eligible to commute a fraction of his provisional pension authorised under Rule 69 of the Pension Rules or the pension, as the case may be, during the pendency of such proceedings.

(11.3) Whether the family can be given the benefit of 40 per cent commutation if a pensioner dies before exercising option?

No, since the commutation does not become absolute in such cases the benefit cannot be given to the family.

(11.4) What will be the effective date of reduced pension if,

a) The applicant is drawing pension from PAO?

b) The applicant is drawing pension from a branch of Public Sector Bank?

c) A Government servant who retired on superannuation and commutation applied in Form 1-A of CCS(Commutation of Pension) Rules before the date of retirement and commutation paid through Head of Office within the first month of retirement ?

(a) The reduction in the amount of pension on account of the commutation shall be operative from the date of receipt of the commuted value of pension or at the end of three months after issue of authority by the PAO for the payment of commuted value of pension, whichever is earlier.

(b) The reduction in the amount of pension on account of commutation shall be operative from the date on which the commuted value of pension is credited by the bank to the applicant’s account to which pension is being credited.

(c) The reduction in the amount of pension on account of commutation shall be operative from its inception. The commuted value is paid in two stages as such the reduction in the amount of pension shall be made from the respective dates of the payment as per (a) or (b) above, as the case may be.

(11.5) How does the period of 15 years for restoration of commuted portion of pension reckon?

The 15-year period for restoration may be reckoned from the date of retirement itself only in case where the payment of commuted value of pension was/is made during the first month of retirement leading to appropriate reduction on account of commutation in the first pension itself. In all other cases, where the commutation of pension led/leads to a reduction in the second or subsequent month, the 15-year period will be reckoned from the date on which reduction in pension became/ becomes effective.

(11.6) Is any authorization for restoration of commuted portion of pension after 15 years required from PAO/CPAO?

No, Restoration of commuted portion of pension after 15 years (from the date of crediting of commuted value) or as fixed by the Government from time to time is to be made automatically by bank. In cases where the date of commutation is not readily available in the PPO, the bank will obtain the information from the concerned PAO who issued the PPO through CPAO before restoring the commuted portion of pension.

(11.7) What has the pensioner to do for restoration of commuted portion of pension? From what date is it restored?

Commuted portion of pension is to be restored after 15 years from the date of commutation. This restoration was introduced w.e.f 01.04.1985. The commuted amount of pension shall be restored on completion of fifteen years from the date the reduction of pension on account of commutation becomes operative in accordance with Rule 6 of CCS (Commutation of Pension) Rules provided that when the commutation amount was paid on more than one occasion on account of upward revision of pension, the respective commuted amount of pension shall be restored on completion on fifteen years from the respective date(s).

(11.8) What is reduce/residual/residuary pension?

Reduce/residual/residuary pension is the part of pension which is payable after deducting commuted portion of the pension.

(11.9) What would be the age to be used for commutation of additional commutable pension and which factor would be used for such additional commuted value of pension?

The age reckoned for calculation of commuted value of pension at the time of original application for commutation of pension will apply for calculation of commutation value of additional commutable pension. However, as mentioned in the OM dated 04.08.2016, the commutation factor in the revised Table of Commutation Value for Pension will be used for the commutation of the additional amount of pension that has become commutable on account of retrospective revision of pay/pension.

(11.10) From which date the reduction in pension on account of additional commutation of pension will take effect?

Reduction in pension on account of additional commutation of pension will be in two or more stages as per the provisions contained in Rule 6 and Rule 10 of the CCS(Commutation of Pension) Rules,1981.

(11.11) What will be the date of restoration of additional commutation of pension?

The commuted portion of pension shall be restored after 15 years from the respective dates of commutation as provided in Government of India decision No.1 under the Rule 10 of CCS(Commutation of Pension) Rules,1981. Necessary endorsement should be made on PPO.

(11.12) A person with D.O.B. on first of month retires in the previous month. What will be the value to be taken for calculation from commutation table ?

The commutation of pension become absolute on the date following the date of his retirement. The commutation value taken will be Age on 61st Birthday (i.e. 8.194) in the present commutation table, if he has retired on attaining the age of 60 years.

(11.13) Whether a person who has commuted some percentage of his pension, can commute remaining part up to maximum of 40% afterwards( e.g if a person have commuted 20% of his pension on retirement and the same was duly authorized, whether he can commute the remaining 20% of his pension)?

There is no provision for second option for commutation after the first option becomes absolute.

AUAB calls on to hold powerful street corner meetings against Subsidiary Tower Company.

The meeting of the AUAB, held on 24.04.2018, has called on the employees to conduct powerful street corner meetings from 07th to 11th May, 2018, against the anti-BSNL policies of the government and demanding the rolling back of the Subsidiary Tower Company. The AUAB has issued a joint circular, requesting the employees to conduct the programme effectively, giving guidelines for the programme.

AUAB has demanded meeting with the Hon’ble Minister of State for Communications and the Secretary, DoT, to review the action taken on the issues of wage revision, pension revision, left out issues of 2ndPRC, payment of pension contribution on actual basic pay, rolling back of the Subsidiary Tower Company, etc.

BSNL CORPORATE OFFICE HAS ISSUED ORDER FOR RELEASING QUARTERLY MEDICAL ALLOWANCE TO THE RETIREES FOR THE REMAINING TWO QUARTERS OF 2017-18.

AIBDPA has been pursuing with the management to issue the orders for extending the quarterly medical allowance  (without voucher) beyond the two quarters of the financial year 2017-18. A detailed letter was also written in this regard narrating the difficulties being experienced by the retirees due to the uncertainity. BSNLEU had also taken up the issue and a decision also taken for an agitation on 03-05-2018 in this regard. Due to these pressures, the management has now issued the order for extending the quarterly medical allowance for two more instalments.
