OFFICE MEMORANDUM

Subject: Court orders against Government of India instructions on service matters — consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.

The undersigned is directed to refer to this Department’s O.M. of even number dated 16.03.2016 (copy enclosed) on the above mentioned subject and to say that the Department of Personnel and Training is the nodal Department that formulates policies on service matters and issues instructions in this regard from time to time. Vide para 4 of the O.M. dated 16.03.2016, it was explained how action on different decisions/orders of the Courts/CAT has to be taken after consulting Department of Legal Affairs and DOP&T.

2. In this regard, it is pertinent to point out here that the Parliament committee on the Welfare of SCs and STs in its report has observed that the above instructions are not being followed stringently by the Ministries/ Departments. The Ministries/Departments are independently fighting out service related cases to the detriment of employees particularly those belonging to the reserved categories. The Committee, therefore, desired that this Department reiterate the standing instructions.

3. In view of the above, all the Ministries/ Departments are once again requested to scrupulously follow the instructions contained in this Department’s OM dated 16.03.2016 while taking action on the decisions/orders of the Courts/CAT.

4. Hindi version will follow.

IT WAS A TOTAL STRIKE IN BSNL ON 15-12-2016 AGAINST TOWER COMPANY FORMATION.

Demonetisation – Where are the currency notes promised by PM?

A reported statement of the RBI says that more than 80% of the banned old notes have been received by the RBI as on 10th December. It comes to Rs. 12.44 lakh crores according to RBI. Well and good. But how much new notes have been issued? RBI says it has released notes worth Rs. 4.61 lakh crore, meaning one-third of the money taken back. While the old notes are in Rs. 1,000 and Rs. 500, the new notes are mostly of Rs.2,000 and some in Rs.500. Out of these, notes worth lakh of crores are diverted to the hands of money launderers and bigwigs through corrupt Bank officials and political patronage. Almost every day such people are caught, but it may be 2-3% only of the launderers.

The poor and middle class people continue to stand in front of the banks and ATMs in hundreds to get some money to cater to daily needs. PM, FM and those in the government make high speeches about the benefit of digital system as also assuring that this trouble will continue only for a few days or weeks more.

The job of the government is not to harass the people; but that is what is actually happening. In fact, the demonetisation is an attack on the poor people. The people should give a fitting reply to this attack .

SBI moves for VRS in affiliated banks before merger

It is reported that the SBI Board has cleared Voluntary Retirement Scheme (VRS) for the employees of the affiliated banks which are going to be merged with it. The intention is to retrench 55,000 officers and staff, who are above 55 years of age.

The affiliated banks which are proposed to be merged are: State Bank of Bikaner and Jaipur, State Bank of Travancore, State Bank of Patiala, State Bank of Mysore and State Bank of Hyderabad.

In fact there is no need fr the merger except to reduce the PSU Banks, in order to help the private banks to increase their business. The bank workers are resisting the move. Our full support to them
