Staff Side, National Council approaches Members of Parliament on Strike issues.

Respected Sir/Madam,

Sub: Non-settlement of genuine demands of the Central Government Employees

More than 32 lakh Central Government Employees working in various ministries of the Government of India. including Railways, Postal, Defence (Ordinance Factory and other Civilian Employees), Central Secretariat, Income Tax, Audit & Accounts and other employees of the government departments are aggrieved since long on non-settlement of their various demands.

The report Of the Vll CPC has further made them aggrieved because of the retrograde recommendations, including non-scientific calculation of Minimum Wage and Fitment Formula. The issue of National Pension Scheme(NPS) had been very heartburning for more than 1.1 million young Central Government Employees who have been deprived from the Defined Pension/Family Pension and we are agitating this issue with the Central Government since its inception.

Under the above compelled circumstances, the National Joint Council of Action has taken a decision to go on “‘Indefinite Strike” from 06:00 a.m. on 11th July. 2016

The Central Government Employees of this country have always stood for the development and good governance of the country. but do feel de-motivated because of the inaction on their pending demands. we do have written to Hon’ble Prime Minister of India vide letter No.NC/JCW2016/CS/PM dated 14.06.2016 (copy enclosed for ready reference) the request that. the government should immediately come forward for negotiated settlement with the NC/JCM on the demands of the Central Government Employees to avoid unnecessary confrontation.
We earnestly hope that. you will kindly lay your hands and support us in our struggle as well as put pressure on the Government of India far resolution of our genuine demands at an earliest

ON 17-06-2016, WHEN COM. K.G.JAYARAJ, GENERAL SECRETARY CONTACTED SHRI. S.K..JAIN, DDG (ESTT), DoT HE WAS NOT ABLE TO STATE WHETHER THE  FINAL CABINET NOTE IS SENT AND ASKED GENERAL SECRETARY TO CONTACT THE DIRECTOR (ESST) . UNFORTUNATELY, THE DIRECTOR WAS NOT AVAILABLE AND COULD NOT GET THE INFORMATION.

WE USUALLY PUBLISH SUCH NEWS ONLY AFTER AUTHENTICALLY CONFIRMED BY THE RESPECTIVE AUTHORITES.

NOW, 20-06-2016,COM. V. A. N. NAMBOODIRI, ADVISOR WENT TO SANCHAR BHAWAN AND MET THE CONCERNED OFFICERS AND GOT THE INFORMATION THAT THE CABINET NOTE HAS BEEN SENT TO THE CABINET SECRETARIAT ON 17-06-2016. 

IT IA GOOD DEVELOPMENT, THOUGH BELATED, AND LET US HOPE THAT THERE WILL NOT BE ANY OTHER HINDRANCE FOR APPROVAL  BY THE CABINET.

Sub: Non-settlement of our demands – Decision to go on “Indefinite Strike” commencing from 11.07.2016 – Request for your intervention and support.
 
I write this on behalf of the apex level body of all Central Government Employees Organizations who are participating in the Negotiating Forum; called the Joint Consultative Machinery.The JCM as a Negotiating Forum was conceived and implemented in 1966 after the prolonged discussions with the Staff Associations and Federations in the Central Services in the wake of the first industrial action in 1960. The idea of setting up the JCM was in realization of the absence of a platform to discuss, deliberate and settle the demands / issues / grievances / problems of the Civil Servants. Up to 1995-96 the JCM, which has a three level negotiating platform was functioning well, meetings were regular. However, after the promulgation of the new recognition rules in 1993, the meetings at the Ministry level became few and far between and at the national level, the deterioration steped in a little later. The National Council, which was to meet thrice in a year, did not meet even once in a year. The last meeting of the National Council was held on 15.05.2010. The organizations participating in the JCM were demanding the meeting to be held, but the pleas were ignored by the successive Cabinet Secretaries. The Charter of Demands (copy enclosed), in pursuance of which the strike is decided to be organized, has arisen due to long neglect of the grievances of the employees / workers.
When the 7th CPC was set up in February, 2014, no announcement for Interim Relief or DA Merger was made by the then Government, which had all along been the practice whenever the Government had set up the Pay Commissions earlier. We fully cooperated with the Commission, submitted a memorandum detailing the issues and explained the reasoning behind each demand. The 7th CPC submitted report on 19.11.2015 to the Government.  In our communication dated 10.12.2015 (copy enclosed), we sought improvement / amendment over the recommendations of the 7th CPC and explained our demands  both in writing and orally before the Empowering Committee. Most of the meetings were monologues except perhaps the last one. What we have understood, is that, the Empowering Committee might not come forward to make any major changes. A fruitful meeting is supposed to be a dialogue where both parties at the negotiating table exchange their understanding, views and difficulties and reach a mutually acceptable position. In 1998, when the then Cabinet Secretary decided not to have such a dialogue with the Staff Side and unilaterally issued the Government Notification on the 5th CPC recommendations, the then Government did set up a Committee of Group of Ministers. The GoM held discussions on all issues and averted the strike action. The 1998 situation establishes, without an iota of doubt, that the Staff Side has always taken reasonable stand on all the issues and paved way for settlement.
The one and only recommendation made by the 7th CPC was to provide some relief to the past old pensioners. The Department of Pension & Pensioners Welfare has unfortunately recommended to the Cabinet Secretary that, even that recommendation must be rejected on the specious plea that the requisite relevant records might not be available.
These developments have caused anguish, anxiety and anger amongst the workers. It is now more than six months that the Commission submitted its report. If the Government comes forward to hold a meaningful discussion with the leaders of the NJCA, a mutually acceptable settlement can be brought about and the impending strike, slated to commence from11.07.2016, can ultimately be avoided.

Office Memorandum

Subject:- Revision of pension of pre-2006 pensioners- delinking of revised pension from qualifying service of 33 years.

Taking into consideration DP&PW OM No. 38/37108-P&PW (A) dated-06.04.201,6, instructions were issued for processing of cases of pre-2006 pensioners by delinking of revised pension from qualiffing service of 33 years vide this office OM No. CPAO/IT& Tech/ Revision (Pre-2006)l2}l6-17lll dated-l2th April,2016 and subsequent OM No. CPAO/IT &TecW Revision (Pre-2006) l2Ol6L17ll9 dated,-27th April, 2016.

2. In this context, DP&PW has clarified the position vide their ID No.38/6/16-P&PW-(A) dated-l3.05.2016 that in accordance with CCS Pension Rules, pension is admissible if the retiring/ absorbed employee has completed a qualiffing service of l0 years at the time of retirement/ absorption. Therefore, all those pensioners who were drawing monthly pension after completion of 10 years qualifying service before 01.01.2006 are eligible for benefit in term of OM dated-01.09.2008 and 06.04.2016.

These orders are however, not applicable to those absorbee pensioners who had got 100% lump-sum in lieu of their monthly pension on absorption in PSUs etc. during 1973-7995 and are eligible for restoration of only 1/3’d of their pension in respect of such absorbee pensioners. However, the absorbee pensioners, who are receiving full monthly pension would continue to be covered by the OM dated-0l.09.2008 and06.04.2016 referred to above.

Further, all Pr. CCAs/CCAs/ CAs/AGs and Administrators of UTs were advised to verify, the list of PPO numbers for revision provided by CPAO in their PAOs login, from their records as to whether these PPO numbers are covered by DP&PW OM dated-06.04.2016. The other cases which were not available in the list provided by CPAO but covered under the OM dated-06.04 .2016 were also to be revised.

It is to ensure that cases of compulsory retirement pension and compassionate ailowance under Rule-40 & 4l o.f CCS @ension) Rules,1972, are not to be revised as they are not covered by the OM dated 06-04-2016

Com.M.P.Kunhanandan laid to rest

Com.M.P.Kunhanandan, veteran leader of the P&T employees and former all India  treasurer of AIBDPA who expired on 14th June 2016 was cremated today at the electric crematorium Mavoor Road , Kozhikde.  He was 67 and left behind his wife P.K.Vineetha, Retd High School Headmistress and two sons, Suhas and Sandesh, both employed at Bangalore.

A large number of comrades, friends and acquaintances including A. Pradeep Kumar, MLA, P.Mohanan Master, District Secretary CPI(M), M.K.Raghavan, M.P., Thottathi Ravindran, Mayor of Calicut, Smt. Meera Darshak, Dy.Mayor, Corporation Councillors, V.A.N.Namboodiri, Advisor, AIBDPA,M. Vijaya Kumar, Org Secretary, BSNL Employees Union, K.G.Jayaraj, General Secretary,AIBDPA, R.Aravindakshan Nair, CHQ Treasurer, AIBDPA, N. Guruprasad, Circle Secretary, AIBDPA , P.Manoharan, Asst Circle Secretary, BSNLEU  Karayi Sreedharan, Circle Patron,Circle Office bearers and district Secretaries and other important functionariesof AIBDPA and leaders of all political parties visited his house and conveyed condolences.

A Condolence Meeting was held afterwards at the Sports Council Auditorium, near Telephone Exchange, Kozhikode attended by a large number of people from different sections of society. V.A.N.Namboodiri presided. Guruprasad (Circle Secretary, AIBDPA,Kerala)  and a host of leaders spoke and  mentioned about the great contributions made by Com. Kunhanandan in the various fields he worked.

 

COM.M.P.KUNHANANDAN ,EX-TREASURER, AIBDPA PASSES AWAY.

WITH PROFOUND GRIEF AND SHOCK WE REPORT THE SAD DEMISE OF COM.M.P.KUNHANANDAN, EX-CHQ TREASURER AT 1020 AM ON 14-06-2016. HE HAS BEEN UNDER TREATMENT FOR THE DRACONIAN DISEASE FOR THE LAST FEW MONTHS; BUT THE END CAME QUITE UNEXPECTEDLY AT A HOSPITAL IN KOZHIKODE. AIBDPA DIPS ITS BANNER IN RESPECT OF THE MOST DEVOTED AND SINCERE LEADER AND CONVEY CONDOLENCES TO THE BEREAVED FAMILY.

THE FUNERAL WILL TAKE PLACE AT KOZHIKODE AT 10 AM ON 15-06-2016.

NOTICE FOR THE INDEFINITE STRIKE FROM JULY 11, 2016 SERVED ON 09-06-2016- DEMANDS OF THE PENSIONERS .

All the central government employees organisations in the National Joint Action Committee have served the notice to the respective heads of departments for the indefinite strike from 11th July, 2016 with massive protest demonstrations on 9th June, 2016. Following are the demands of the pensioners included in the charter of demands for the strike.
13   Revise the pension and other retirement benefits as under:-
(a)  Parity between the past and present pensioners to be brought about on the basis of the 7th CPC recommendations with the modification that basis of computation to be  the pay level of the post / grade/ scale of pay  from which one retired; whichever is beneficial.
(b)  Pension to be 60% of the last pay drawn in the case of all eligible persons who have completed the requisite number of years of service.
(c)  The family pension to be 50% of the last pay drawn.
(d)  Enhance the pension and family pension by  5% after every five years and 10%  on  attaining the age of 85 and 20% on attaining the age of 90.
(e)  Commuted value of pension to be restored after 10 years or attaining the age of 70, whichever is earlier. Gratuity calculation to be on the basis of 25 days in the month as against 30 days as per the Gratuity Act.
(f)   Fixed medical allowance for those pensioners not covered by CGHS and REHS to be increased to Rs. 2000 p.m.
(g)  Provide one increment on the last day in service if the concerned employee has completed six months or more from the date of grant of last increment.
14   Exclude the Central Government employees from the ambit of the National Pension Scheme (NPS) and extend the defined benefit pension scheme to all those recruited after 1.1.2004
