Comrade, Meeting between the Secretary, Telecom and the AUAB. A meeting between Ms.Aruna Sundararajan, Secretary, Telecom and the All Unions and Associations of BSNL(AUAB) was held on 02.11.2018. Com.P.Abhimanyu, GS/BSNLEU, Com.Chandeswar Singh, GS/NFTE, Com.K.Sebastin, GS/SNEA, Com.Prahlad Rai,GS/AIBSNLEA, Com.Ravi Shil Verma, GS/AIGETOA, Com.Suresh Kumar,GS/BSNL MS, Com. Revti Prasad, AGS/BSNL ATM, Com. Rashid Khan, AGS/TEPU and Com.H.P.Singh, Dy.GS/BSNL OA participated in the talks on behalf of the AUAB.

From the DoT, Ms. Anuradha Mitra/Member(Finance), Shri Ravi Kant/Member(Services), Shri.N.Sivasailam/Special Secretary and Shri R.K.Khandelwal/ Joint Secretary(Admn.) participated.

From the BSNL Management Side, Shri Anupam Shrivastava/CMD BSNL, Ms. Sujata T. Ray/ Director(HR), Shri Saurabh Tyagi/Sr.GM(Estt), Shri A.M.Gupta/GM(SR) and Shri Sheo Shankar Prasad/DGM(Estt.) participated.

At the outset, the representatives of the AUAB pointed out that DoT failed to take appropriate action to implement the assurances given by the Hon’ble MoS(C) in the meeting held on 24-02-2018, in view of which the AUAB has been compelled to go on agitational programme. On the 3rd Pay Revision issue, the Secretary, Telecom assured that the Cabinet Note, for getting the approval of the Cabinet, would be sent at the earliest. The AUAB pointed out that within three months the Pay Revision issue has to be settled fully, otherwise, Parliament elections would be announced, settlement of Pay Revision would become difficult. Secretary informed that some queries are there, it will be raised by DoT to BSNL in a week. As and when BSNL replies it will be processed. AUAB demanded the formalities of Cabinet memo to be completed before this month. Secretary, Telecom assured to act fast.

On the issues of allotment of 4G spectrum, Payment of Pension Contribution on the actual basic pay and Pension Revision issues, very useful discussion took place. On the 4G issue, the Cabinet Note has been sent for inter-ministerial consultation, and soon it will go for the approval of the Cabinet. On the issue of Payment of Pension Contribution on actual basic pay instead of maximum of the pay scale, the matter is being recommended for the approval of the Department of Expenditure, with a positive note of the DoT, by next week.

On the Pension Revision of BSNL retirees, the Secretary Telecom appeared to be convinced with the arguments of the AUAB, that it should not be linked with the Pay Revision of the serving employees. She directed the Member (Services) to immediately discuss the issue with her.

On the 30% Superannuation benefits for the Directly Recruited employees, the Secretary Telecom said that it should be settled by the BSNL. Thereafter CMD assured to examine another 2%. After the meeting with the Secretary, Telecom, the meeting of the AUAB was held and a review was made. The meeting expressed it’s satisfaction about the discussions on the issues of Allotment of 4G spectrum, Payment of Pension Contribution and Pension Revision.

Even though the approach of the Secretary, Telecom, was positive yesterday, the AUAB meeting viewed that the progress in the matter of 3rd pay revision is not satisfactory. Hence, the meeting decided to go ahead with the agitational programme of holding rallies on 14.11.2018, and called upon the employees to effectively organise the same. It is decided that the AUAB will again meet on 14-11-2018, to review the situation. Organisational decisions of the AUAB.

Prior to the meeting with the Secretary, Telecom, a meeting of the AUAB was held at NFTE’s office, under the chairmanship of Com. Chandeswar Singh, GS, NFTE BSNL. After finalising the strategy to be adopted in the meeting with the Secretary, Telecom, the meeting discussed about the ways and means to strengthen the unity of the AUAB and its functioning. After detailed discussion, the following decisions are taken unanimously:-

(1) Com.Chandeswar Singh, GS, NFTE BSNL, is elected as the Chairman of the AUAB.

(2) Com.P.Abhimanyu, GS, BSNLEU, is elected as the Convenor of the AUAB.

(3) Notices for struggles will go with the signatures of all the General Secretaries of the constituents.

(4) All other letters / communications to the BSNL Management/ DoT / Government, will be signed by the Chairman and the Convenor.

(5) AUAB should immediately be formed at all circles and districts, wherever it is not formed so far. As regards the posts of Chairman and Convenor, the pattern adopted at the All India level should be adopted at the circle and district levels also

Dear  Sir,

                                Sub:Modified assured Career progression Scheme- date of implementation

                                Decision of the Supreme Court of India- issuance of orders regarding.

                We  solicit your kind attention to the order issued by the DOPT introducing  MACP scheme, which came into effect from.1.9.2008 onwards.  Aggrieved by the  provision concerning the date of effect,  the Staff Side, National Council JCM had both on behalf of the working employees and Pensioners introduced items in the agenda of the National Anomaly Committee for making the scheme effective from 1.01.2006  The issue was considered as an anomaly for the reason that while  the pay structure was implemented with effect from 1.1.2006, the date of effect for MACP was  unfortunately determined to be 1.09.2008.  No decision was taken by the Government on that item  Rather the official side dilly dallied the issue indefinitely. Even if they would have disagreed, the item would have as per the scheme of things been got referred to the Arbitrator.

                The matter was taken up by a few Defence Personnel before the Armed Forces Tribunal, whose orders were clearly against the stand taken by the Government. Instead of accepting the decision of the Honourable Tribubnal, the petitioners were dragged first to the High Court, and later to the Supreme Court  The Honourable Supreme Court vide their order in W.P.No.3744/2016 dated  8.12.2017 directed the Government to accept the verdict of the Armed Forces Tribunal as that was rightly pronounced.  Having left with no alternative,  the Ministry of Defence issued the orders vide their letter in 14(1)/99-d(ag) dated 25.7.2018 making the decision of the Armed Forces Tribunal applicable only in respect of Defence armed personnel, leaving out the Civilian employees and pensioners  from the ambit of the order.

                We have been given to understand that the Secretary, Staff  Side National Council  had taken up the issue of giving effect to the MACP from 1.1.2006  with the Government  through correspondence first on 16th January, 2018 i.e. immediately after the verdict of the Supreme Court and once again on 7th August, 2018, after the issuance of the orders by the Ministry of Defence  extending the benefit of the verdict to the Defence personnel.   To the best of our information and knowledge, the Department of Personnel did not even acknowledge these communications from the Staff Side, leave alone responding to it.

                Recently, the Mumbai High Court in their order in WP no. 1763 of 2013 dated 15.10.2018

In the case of..Shri M..P Joseph Vs. Union of India and three others has directed the Government to  immediately refix the pay and pension of the petitioner on the basis of the Supreme Court Verdict cited ,  failing  which to pay him interest at the rate of 6%.

                There are number of pensioners who will stand to financial benefit, if the Supreme Court verdict is implemented.  The Honourable Supreme Court on more than one occasion has ruled that the decisions of general nature must be extended to all similarly placed employees/pensioners.   In the case of Inderpal Yadav Vs. Union of India,(1985)SCC 648, the Supreme Court had stated :

“Those who could not come to the Court need not be at a comparative disadvantage position to that who rushed in here if they are otherwise similarly situated, they are entitled to similar treatment.”

               

                We appeal to you on behalf of the pensioners that the matter concerning the date of effect of the MACP may be taken up with the Department of Expenditure and Department of Personnel and ensure that orders are issued making the verdict of the Supreme Court in the case of Armed personnel are made applicable to all similarly placed civilian employees/Pensioners without further loss of time.   In other words, the MACP scheme may be made operative from 1.01.2006 to all Central Government employees/pensioners.  We expect to receive a  reply from your end.

Italy: Ten thousand in Rome claim “Nationalizations here and now”- WFTU NEWS

A large popular demonstration invaded the streets of the capital to claim “Nationalizations here and now”.

The event, organized by the Unione Sindacale di Base – to inaugurated the “International Week of Fight against privatizations” called by TUI PS&A to which other political and social groups have joined.

Ten thousand have paraded from Piazza della Repubblica to San Giovanni to demand that entire pieces of the strategic sector of the country back under public control, starting with Autostrade, the Benetton family company protagonist of the massacre of Ferragosto in Genoa, continuing with Alitalia, Telecom and all the other companies sold off to the so-called courageous captains, heroic only in churning out crises and layoffs.

The event, organized by the Unione Sindacale di Base – to inaugurated the “International Week of Fight against privatizations” called by TUIPS&A to which other political and social groups have joined .

During the rally there were many interventions especially that one of Mimmo Lucano, mayor of Riace, famous in the world for his model of integration arrested in early October by the Italian government on charges of aiding illegal immigration, Lucano greeted the people among the cheers. “We must say no to barbarism – and if it was possible in Riace, with more reason we can all make an effort for a normal Italy”.

Emotion for the greeting of the representative of the Amiu ( Municipal Waste Company) of Genoa who recalled the three comrades killed by the collapse of the Morandi bridge.

POWERFUL AUAB DHARNA THROUGHOUT THE COUNTRY- PENSIONERS JOINED.

All Unions and Associations of BSNL (AUAB) organised impressive Dharna all over the country against non implementation of assurances given by Shri.Manoj Sinha, Hon’ble Minister for Communications to the AUAB leaders on 24-02-2018. The assurance covered the demands of wage revision, pension revision, grant of 4G spectrum to BSNL, Pension contribution on actual basic pay and 30% superannuation benefits to the directly recruited employees.

Responding to the CHQ call, AIBDPA members participated in the Dharna everywhere in large numbers. CHQ heartily Congratulates all the participants for the support and solidarity to the struggle of AUAB.

KANNUR DISTRICT HAS CONTRIBUTED Rs. 50,000 TO THE AIC FUND.

CHQ had requested all its units to collect Rs.100 from each member and to send 50% to the Reception Committee, 3rd Triennial All India Conference at Kolkata for the successful conduct of the AIC. Accordingly, Kannur District Branch in Kerala has sent Rs.50,000 to the Reception Committee, 1000 members @50 = 50,000.

CHQ heartily congratulates Kannur District and it will have a positive impact on other units to follow suit.

Dharna by BSNL Unions and Associations on 30th October 2018- Participate in large numbers and make it a grand success.

BSNL employees and officers as per the call of the All Unions and Associations of BSNL (AUAB) will sit in dharna on 30th October 2018 in front of Offices / exchanges demanding immediate Wage revision and Pension Revision w.e.f. 01-01-2017, Payment of Pension contribution only on the basis of actual pay, Allotment of 4G Spectrum to BSNL and Implementation of the recommendations of the 2nd PRC in respect of superannuation benefits to BSNL directly recruited employees.

The Communications Minister had assured in February 2018 itself, when the workers went on agitation, that the demands will be favourably considered and the DOT was asked to initiate the formalities. However, nothing happened during these months. Hence the present action programme.

AIBDPA, the mighty organisation of the BSNL and DOT Pensioners have extended its full support and solidarity to the struggle. As usual, large number of pensioners will also participate.
