Veteran leader and AIBDPA Advisor, Com.V.A.N.Namboodiri has been elected President of Senior Citizen Friends Welfare Association, a major and prominent organisation of elders in Kerala. The two days Annual Conference of this organisation was held at Kozhikode on 23-24, November, 2017. Com.Amaravila Ramakrishnan Nair is the General Secretary and Com.P.V.Chandrasekharan , Patron, AIBDPA is functioning as one of the Vice Presidents.

BSNL FACES THE JIO CHALLENGE EFFECTIVELY

Jio Added 5.9 Million Users in September, but India’s Telecom Subscriber Base Declined by 2.9 Million
HIGHLIGHTS
Most of the churn was in urban wireless connections

Even as Reliance Jio subscriber base increased by nearly 6 million in September 2017, the country’s overall telecom user base dipped by 2.9 million. According to data released by Telecom Regulatory Authority of India (TRAI), the churn can be attributed to the 2.38 million wireless connections in urban areas going off the grid. It should also be pointed out that there were several thousand disconnections in rural wireless and wireline networks. In fact, there were only three operators that added subscribers in September across India – Jio, BSNL and Airtel.

The TRAI data shows there were 40,000 urban wireline disconnections, and 420,000 and 30,000 disconnections in rural wireless and wireline networks, respectively. The country’s total subscriber base as of September 2017 stands at 1.206 billion, with 1.183 billion wireless subscribers and 23.67 million wireline consumers. There were 5.49 million MNP (mobile number portability) requests across the country, and the total number of requests has finally crossed 300 million since the facility was rolled out in in 2010.

Airtel is the country’s largest mobile service provider with 282.02 million users and 23.84 percent market share, followed by Vodafone (207.37 million, 17.53 percent) and Idea Cellular (190.1 million, 16.07 percent). On the fourth and fifth positions are Jio and BSNL with 138.6 million and 11.72 percent share, and 105.76 million users and 8.94 percent share, respectively.

As for wireline subscriber base, there was a net decline of 0.10 million users in September, going down from 23.77 million to 23.67 million. BSNL is the market leader in wireline telecom segment with 54.06 percent market share. It is followed by Airtel (16.49 percent) and MTNL (14.38 percent).

Coming to broadband Internet access – which TRAI defines as wireless and wireline networks delivering speeds of 512kbps or above – 324.89 million people in the country had access to high-speed Internet in September. This represents a 2.66 percent increase in the same figure in the preceding month, up from 316.48 million. Of this 324.89 million, 306.39 million used broadband speeds on mobile devices (phones and dongles). On the back of its 4G-only network, Reliance Jio is the market leader in delivering broadband speeds and accounts for 138.6 million of these users and 42.67 percent market share. Airtel (62.29 million, 19.17 percent), Vodafone (45.98 million, 14.15 percent) and Idea (29.61 million, 9.12 percent) take the next three spots in this ranking.

The Human Chain program called by All Unions and Associations of BSNL prelude to the two days strike on 12-13, December, 2017, was held on 23-11-2017 all over the country with massive participation of both executives and non executives. As per AIBDPA directive, pensioners also joined the program. The demands put forward for the agitation culminating in two days strike are (1) Wage revision with 15% fitment from 01-01-2017 and (2) Drop the proposal to form a separate tower company.

We demand the central government to immediately settle the genuine issues amicably and avoid the strike.

SPECTRUM TO BE ALLOCATED WITHOUT AUCTIONS ? MAY LEAD TO HEAVY LOSS TO THE EXCHEQUER.

According to a report published in the Times of India dated 23-11-2017, the Telecom Department is considering allotting valuable V- Band Spectrum without auctions. The move is a gross violation of the Supreme Court judgment on 2G which had clearly laid down that government shall allocate spectrum to private operators only through an auction process.

If the government also agrees, most probably it may happen too, and allot the spectrum on first-come-first-served basis (FCFS) without auction the size of the potential revenue loss to the exchequer could be at least Rs.4,77,225 crore. 

This is another instance on which the government succumbing to the pressure of the corporates compromising the national interest.

EPF PENSIONERS LIKELY TO GET SOME RELIEF- IMPACT OF SUPREME COURT RULINGS.

We are reproducing below a news item appeared in Times Of India dated 23-11-2017 claiming massive rise in private sector pensions. How ever it depends on the approach of the government on this vital issue.

In his 37-year career Praveen Kohli hadn’t got the kind of hike that he received four years after he retired as a general manager with Haryana Tourism Corporation. On November 1 this year, Kohli’s pension rose by nearly 1200%-from Rs 2,372 to Rs 30,592 per month.

The windfall was courtesy a Supreme Court order of October 2016 that directed theEmployees’ Provident Fund Organisation (EPFO)+ to revise the pension of 12 petitioners under the employee pension scheme (EPS).

The pension scheme, which is part of EPF, has over 5 crore members. Every employee in the organised sector contributes 12% of basic salary and dearness allowance to EPF. The employer makes a matching contribution. Of the employer’s contribution, 8.33% goes to the EPS. When people withdraw their EPF after a job switch or during unemployment, the EPS is not given out. It’s payable only after superannuation.

There is also a ceiling on EPS contributions. The current cap on salary (basic + DA) is Rs 15,000 per month so, the maximum one can contribute to the EPS is 8.33% of Rs 15,000, which is Rs 1,250 a month.

Between July 2001 and September 2014, the EPS salary cap was Rs 6,500 a month, which translated to a maximum contribution of Rs 541.4 a month. Prior to 2001, the ceiling was Rs 5,000, which yielded a maximum contribution of Rs 416.5.

So how did 62-year-old Kohli get a pension of over Rs 30,000 a month with such a meagre contribution to the pension fund?

It took a long struggle in which he cited an important amendment to EPS. In March 1996, the EPS Act was amended to allow members to raise pension contribution to 8.33% of full salary (basic + DA) irrespective of what the salary is. This raised the pension, multiple times. However, for a decade hardly anybody opted for higher contribution. In 2005, following media reports, including TOI, several private EPF fund trustees and employees approached EPFO with the demand to remove ceiling on their EPS contribution and raise it to their total salary. EPFO rejected the demand claiming that response should have come within six months of the 1996 amendment.

Cases were filed against EPFO in various high courts. By 2016 all except one high court ruled against EPFO stating that the six-month deadline was arbitrary and the employees must be allowed to raise their pension contribution whenever they wish to. The case went to Supreme Court which, in two separate rulings in 2016, ruled in favour of employees’ right to raise their contributions to pension fund without imposing any cut-off date for eligibility.

It took another year for the EPFO to implement the court order following a strong fight put up by petitioners like Kohli. Finally from November 2017, Kohli started getting a higher pension.

To raise his monthly pension from Rs 2,372 to Rs 30,592 Kohli had to pay Rs 15.37 lakh as the difference between EPS contribution he had made while in service and the contribution he would have made if he was allowed to raise it to his full salary. But he also got Rs 13.23 lakh as arrears for the higher pension that he was entitled to for four years spent in retirement before November 2017. So, by paying Rs 2.14 lakh extra, Kohli was able to raise his lifelong pension by nearly 13 times. In case he passes away before his wife, she will get 50% of Kohli’s last drawn pension till she is alive.

Are all 5 crore members of EPFO now eligible for higher pension if they opt to raise their EPS contribution? Yes, all those who joined EPFO before September 1, 2014 – the date on which the EPS imposed the Rs 15,000 salary cap – can contribute on their full salary to EPS. They can submit applications to their company and the EPFO and get up to half of their last average monthly salary as pension. Those who have joined EPFO after September 1, 2014 and have a salary above Rs 15,000 are not eligible for pension while those starting with salaries lower than 15,000 can contribute to EPS but the cap of Rs 15,000 will kick in when their salary rises.

EPFO is also discriminating against employees who are members of privately managed EPF trusts (nearly 80 lakh) officially called Exempt Establishments and those who directly contribute to the government-run trust (4.25 crore) called Un-exempt Trusts.

Says VP Joy, central provident fund commissioner: “EPS will not be able to give pension to those members whose contributions on higher salary have not been received by EPFO.” The EPFO is denying employees of exempt companies higher pension on the grounds that only 8.33% of up to Rs 15,000 and not their entire PF contribution goes to EPS.

However, two of the 12 petitioners who went to court were from the exempt category so a precedent has been set. It’s likely that members of private trusts or the trusts themselves will go to the court to settle the issue. The EPFO’s board of trustees is also likely to discuss the move to bar exempt EPF trust

Air India moves fast for disinvestment

Despite strong protests from the unions in Air India and the Central trade Unions, Air  India is moving fast for strategic disinvestment as per the decisions of the government. Private companies have been pressing the government to keep away Air India from the sky so that they can exploit the travellers without any limit and be the unquestioned kings of the sky.

Though some of the government spokesmen were telling that Air India disinvestment has not been decided, the Air India management is moving forward with the process. Five internal project teams have been constitutes as reported in Hindu dated 22-11-2017 to work towards ensuring that the timelines set by the government in the disinvestment matter is achieved.

It is necessary that the disnvestment move of the government is resisted and stopped.

COM.SUKOMAL SEN PASSED AWAY.

With profound grief we report the sad demise of Com.Sukomal Sen Ex MP, veteran leader at 10 AM on 222-11-2017 at Kolkata. He was ailing for some time and the end came at a Kolkata hospital. Com.Sukomal Sen was a prominent leader of the working class movement in the country and served in many capacities sincerely and effectively. He was Former General Secretary of All India State Government Employees Federation , Chairman, Central Control Commission of CPI(M), former Vice President,CITU and former General Secretary of TUI (Public Services) of WFTU etc. He was also closely associated with central government employees movement.

AIBDPA dips its banner in respect of the departed leader and conveys heartfelt condolences to his bereaved family.

The second phase of the agitation called by All Unions and Association of BSNL , the HUMAN CHAIN is being organised at District, Circle and Corporate office levels on 23-11-2017 demanding wage revision with 15% fitment from 01-01-2017 to BSNL employees and against formation of separate tower company. As already intimated AIBDPA units are requested to ensure that maximum pensioners are participated in the Human Chain and make it a grand success.
