CENTRAL GOVERNMENT TO REPLACE JUSTICE R.C.LAHOTI IN THE VODAFONE CASE.

 
 
NEW DELHI: The government is close to appointing an arbitrator to replace R C Lahoti, who had declined to arbitrate on its behalf in the Rs 20,000 crore tax case with UK telecom major Vodafone.”We are in the process of finalising a replacement for Justice Lahoti. We are waiting for a final nod from the Minister for the government nominee on the panel,” a senior official said.

The final call would be taken by Minister of State for Finance Jayant Sinha, he added.

The Government had in June 2014 appointed former Chief Justice of India R C Lahoti as arbitrator in the tax dispute case. However, in May 2015 Lahoti recused himself from the arbitration process.

Vodafone has already named Yves Fortier of Canada as its nominee on the panel.

The government and Vodafone had earlier this year decided on the third arbitrator, who will act as chairman of the tribunal, for the case. However, Abdulqawi Ahmed Yusuf of the International Court of Justice declined to be part of the three-member panel.

After India finalises on its nominee on the panel, both the arbitrators would scout for a neutral judge and only then the arbitration proceedings would start.

Following an international arbitration notice by Vodafone, the previous UPA government in May 2014 withdrew its conciliation offer to settle the tax dispute. Earlier, the government had approved the conciliation with Vodafone in June 2013 in a bid to resolve the capital gains tax dispute.

While the basic tax demand was Rs 7,990 crore, the total outstanding, including interest and penalty, is estimated to have risen to Rs 20,000 crore.

The Supreme Court had ruled in Vodafone’s favour in 2012, saying the company was not liable to pay any tax over the acquisition of assets in India from Hong Kong-based Hutchison.

The government, however, amended the tax laws with retrospective effect to undo the Supreme Court judgment and claim tax.

Whether in London, Athens, or Berlin, the workers face the same opponent. The employers want us to live with low wages, when living costs rise. They want us to work without health and safety regulations. They want us to give up our rights. In these conditions the struggle of the workers in London Underground is just and represents the interests of workers of all countries.

WFTU SOLIDARITY TO TURKISH FARM WORKERS.

The World Federation of Trade Unions representing more than 90 million organized workers in 126 countries expresses its deep sorrow to the Turkish people and the families of the road traffic victims; we believe that it is not an accident, but a crime.

The fifteen new victims, (13 women and a child) were trying to reach the fields, where they work gathering vine leaves for 0,5 € (1,5 Turkish Lira) per kilo, most of the workers on the vine fields are women and children.

We consider unacceptable the fact that in the 21st century women and children are obligated to work, especially in such conditions, and without protection measures. Only in 2015, 28 people, most of them women, have lost their lives.

Once again WFTU expresses its solidarity to the Turkish working class; they are not the only victims of the lack of protection measures, of the capitalist exploitation. Workers lose their lives every day in Turkey and around the world. There is only one way to solve this: we add our voice to those continuing the class oriented struggle against the exploitation of man by man, for development based on the needs of those that produce the wealth.

78.2% IDA MERGER- NODAL DEPARTMENTS HAVE NOT RETURNED THE CABINET NOTE.

Com. V. A. N. Namboodiri, Advisor has met Ms. Annie Moreas, Member (Finance), DOT on today, the 8th July, 2015 and discussed the issue of 78.2% IDA merger to BSNL pensioners. The Member (Finance) has stated that the Cabinet Note sent to the four nodal departments, viz , Expenditure, Law, Pension and Public Enterprises is not received back after which only it could be presented to the cabinet for final approval.

It is almost one month that the cabinet note was sent to the nodal departments and it is imperative to pursue with these departments too for early clearance. CHQ is closely watching the developments and will be contacting the nodal departments as the time for normal procedural delay is already over.

This clearly vindicates our decision to go ahead with the two days hunger fast before the CCA offices across the country on 21-22, July, 2015.

DIGITAL INDIA- BSNL NEGLECTED.

 

 

BSNL is the main telecom company to implement the Digital India Project with its vast network all over India. It is the fully government owned PSU.

But it was ignored and humiliated at the Digital India inauguration function at New Delhi. While even the private company heads were given seats in the dais where the Communications Minister was present, the CMD BSNL was not given a seat and was allotted a seat below among the audience.

This is the treatment being given to the BSNL by the Government. It is being ignored and neglected by the government in every way.

We express our strong protest against the humiliation of BSNL and its CMD!

 

 

GOVERNMENT ORDERS SPECIAL AUDIT OF NETWORK TO CHECK CALL DROPS- WILL IT BE EFFECTIVE?

NEW DELHI: Telecom minister Ravi Shankar Prasad on Tuesday ordered a special audit of mobile networks to check call drops. The move is seen as stepping into Trai’s domain as the regulator is mandated to carry out the task of auditing services.Prasad made the announcement of an audit after indicating earlier that the government plans to initiate steps to deal with the issue that is plaguing most networks across the country. Simultaneously, it is facilitating the installation of in-building solutions for network enhancement in government buildings.

The minister said the problem of call drops had attained critical proportions, and this is happening even after the government provided fresh spectrum in the recent telecom auctions. He said Trai has been asked to work out “disincentives” for operators in case their services don’t improve, although they may also receive gains for good quality.

As per the existing set-up, Trai is mandated to carry out audit on quality of services across various cities to monitor network issues and other parameters. However, such exercise by the regulator has been found to be unsatisfactory as it has failed to identify network issues and instead found most of the top operators giving good quality service.

“The special audit will be carried out by the Department of Telecom (DoT) through its TERM (Telecom Enforcement, Resource and Monitoring) Cells in all metro and capital cities. It would assess the gravity of the problem, which will help in planning remedial measures,” Prasad said.

The minister also said the operators should invest in solutions for improving service quality within congested buildings. He, however, agreed that the limited availability of sites for putting up mobile towers, after taking into account radiation and other concerns, was affecting the service quality a reason often cited by the telecom operators for the call drops.

The minister said that the radiation rules implemented in India are 10 times more stringent than international standards.

In a well attended meeting of the BSNLEU, AIBDPA, Trade Unions etc. held today, 6th July at Tirupati, Andhra Pradesh, the Reception Committee for holding of the Triennial All India Conference of All India BSNL DOT Pensioners Association was formed. Com. Y.N.Murthy, President, AIBDPA, Tirupati presided. Com.Y.S.Raju, Dist. Secretary BSNLEU welcomed all and conducted the proceedings. Comrades V.A.N.Namboodiri, Advisor, AIBDPA and Patron BSNLEU, G.Mohan Reddy, Circle President, BSNLEU, J.Sampath Rao, AGS and Circle Secretary BSNLEU, Muralidharan (CITU), Balasubramaniam (APRTC), Ramachandrudu, Circle Secretary AIBDPA, M.Taranath, ACS BSNLEU, M.Raja Reddy, DS AIBDPA, M.Ramachandraiah, retd. DGM and other leaders addressed.

After discussion about the holding of the AIC etc. a Reception Committee was formed with Shri Y Srinivasareddy, MLC, as   Chairman and Com. Y.S Raju, District Secretary, BSNLEU as General Secretary. Com. M.Rajareddy, is elected as Joint General Secretary and com. R.D.V.Prasad is elected as  Treasurer. The Reception Committee includes all important leaders and activists.

All pensioners are requested to furnish their Aadhaar Numbers to their bank, if not already done. The pensioners who do not have “Aadhaar” are requested to obtain Aadhaar number. Pensioners residing in the NCR may visit an Aadhaar Camp on any one of the following days with original PPO, Aadhaar Card, and bank pass book along with photocopies of these documents. Pensioners who do not have Aadhaar number yet may in addition carry a photo id like Voters Card. Jeevan Pramaan is in addition to the other existing facilities for submission of Life Certificate.
